The reason the judge was wearing the mask is because she was required to because she was not vaccinated. I gave oral argument in NYS Appellate Court and because I was not vaccinated I was required to wear a mask. FYI, I had 8 uncontested very detailed and well documented sworn affidavits along with 18 case New York case laws, (some from that very same court) that affirmed uncontested sworn affidavits. establish facts on the record and can't be disregarded.. The NYS Supreme Court, The Appellate Court and the Court of Appeals all turned a blind eye to that compelling evidence and ruled in favor the defendants (NYS Public Service Commission) even though they submitted no counter-sworn affidavits nor provided any case law that supported not filing a counter sworn affidavit. The whole New York Court system is corrupt.

Tons of corruption

Today I know there was over 50 unvaccinated people in the court of Appeals- including all of our attorneys

Not sure how rules are applied

Capital Region resident all of my life-1960 born. NYS is the most corrupt state in the US. Remember Rockefeller was from here-the man who promoted allopathic medicine and shut all other pathways down because pills cod be made with petroleum products thus providing his oil business more profit. Never trust this state and especially NYC.

If the judge is experiencing discrimination based on being regarded as having a limited immune system for more than six months then that meets the prong three definition of disability according to ADAAA (2008). How can the court prove that, that judge’s immune system is putting people at more of a risk or is a direct threat? I’m sure that judged has natural immunity due to seroconversion. Seroconversion is assumed to have occurred in the vaccinated. In the 9th Circuit, COVID shots are not considered vaccinations, they are considered medical treatments. Jacobson v. Massachusetts was distinguished by Carvalajo v LAUSD because the rulings in Glucksberg and Cruzan give you bodily autonomy and bodily integrity. You have the right to refuse medical treatment when doing so does not endanger the general public. Since the COVID shots did not prevent infection or transmission then they only amount to a treatment. That judge is allegedly being discriminated against due to being regarded as disabled, having a limited immune system for more than six months and experiencing adverse employment action (stigmatization) for declining the government’s preferred medical treatment and rightfully making her own medical decision. I hope every teacher across the country wins their cases against the radical overreaching, science denying, untrustworthy government!

We don't know if the assumptions you're basing your analysis on are true or not at this point.

It's fascist that they remove an unvaxxed judge from a case about illegal mandates. They should remove vaxxed as they have more of a bias.

Also, Let's say he wins the argument about how they violated due process. That doesn't fix it for the many others wronged. They gotta file cases and wait months or years.

Why isn't it automatic? Oh right, because it's designed to be slow and drain resources...

But then, most of the legal system is full of brain dead judges who are lead by a profession that has always had the job of covering up for the wealthy.

Remember they didn't count native Americans as people deserving rights?

Same with slaves.

And so on.

I HOPE MORE PEOPLE REALIZE THAT THE LEGAL SYSTEM IS CORRUPT BY DESIGN.

it's about time that we stop pretending like they're about justice.

I spoke to a judge / friend who said Judge Rivera must have removed herself.

But of course there is some sense of peer pressure I believe

That's sad. The legal system has too much politics and group think.

I remember learning about the balance of the executive, legislative, and judicial system in school and believing it exists.

But really it's all one big system and it seems like they just fight over specific things, like abortion, gun rights, etc.

"The real reason that we can’t have the Ten Commandments in a courthouse: You cannot post “Thou shalt not steal,” “Thou shalt not commit adultery,” and “Thou shalt not lie” in a building full of lawyers, judges, and politicians. It creates a hostile work environment." -George Carlin

I’ll wager a net that the teachers’ union doesn't support the teachers. I know PEF is pro-mandate and pick and choose which dues-paying members they will help.

Does Jimmy think a favorable ruling will cover tenured teachers who were coerced into resigning, or just those who were terminated?
